Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of AI Fabrik’s platform, APIs, and services (the “Services”).
By accessing or using the Services, you agree to be bound by these Terms.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
Description of Services
AI Fabrik provides AI inference services, including API-based access to machine learning models and related compute infrastructure. The Services are provided on a commercially reasonable efforts basis. AI Fabrik does not guarantee that the Services will be uninterrupted, error-free, or available at all times unless expressly set forth in a separate written agreement.
The Services operate on a prepaid usage model.
AI Fabrik may modify, update, suspend, or discontinue any part of the Services at any time without liability. Where practicable, AI Fabrik will provide reasonable advance notice of material changes that adversely affect core functionality.
Eligibility and Account Responsibility
You must be at least 18 years old to use the Services.
You are responsible for safeguarding your account credentials and API keys and for all activity conducted under your account. You represent and warrant that you are not located in, under the control of, or a resident of any country subject to U.S. embargo, and are not listed on any U.S. government restricted party list.
Billing and Credits
- The Services operate on a prepaid basis.
- Usage consumes prepaid credits.
- Services may stop when your balance reaches zero.
- Credits are non-refundable except as required by law and except as otherwise expressly agreed in writing by AI Fabrik.
- Pricing may change at any time.
- You are responsible for applicable taxes.
Payments are processed by Stripe. AI Fabrik does not store full credit card numbers.
Customer Content
You are solely responsible for all data, prompts, inputs, files, and materials submitted through the Services (“Customer Content”). As between the parties, you retain all rights, title, and interest in and to Customer Content.
You represent and warrant that:
- You have all necessary rights to submit Customer Content.
- Your use complies with applicable laws.
- Your content does not infringe third-party rights.
You grant AI Fabrik a limited, non-exclusive license to process Customer Content solely to provide the Services solely to provide, maintain, and improve the Services and to comply with applicable law.
To the extent permitted by applicable law, and subject to your compliance with these Terms, AI Fabrik assigns to you any rights it may have in outputs generated for you through the Services (“Outputs”). You acknowledge that Outputs may not be unique and similar outputs may be generated for other users.
If you provide feedback or suggestions, AI Fabrik may use them without restriction or obligation.
Sensitive Data Restriction
You agree not to submit sensitive personal data, including:
- Social Security numbers
- Government ID numbers
- Financial account or credit card numbers
- Health information subject to regulation
The Services are not designed to process regulated data such as HIPAA or financial data. AI Fabrik may immediately suspend or terminate your access upon violation of this restriction.
You agree to indemnify AI Fabrik for any claims arising from your submission of prohibited sensitive data.
Third-Party Models
Certain models may be provided by third parties and subject to separate terms. You are responsible for complying with those terms.
AI Fabrik does not control and is not responsible for third-party models or their outputs. Your use of such models is at your own risk.
Zero Data Retention
AI Fabrik operates as a stateless inference platform:
- Prompts and outputs are not stored
- Inference data is not logged
- Customer data is not used for training
AI Fabrik may retain limited operational metadata such as timestamps, usage metrics, and system logs) for billing, security, and service reliability purposes. Such metadata does not include Customer Content.
Acceptable Use
You agree not to:
- Use the Services for unlawful purposes
- Generate malware
- Reverse engineer or extract models
- Circumvent safeguards
- Interfere with system security
- Violate export control laws
AI Fabrik may suspend or terminate accounts for violations.
AI-generated outputs may be inaccurate and must be independently validated.
AI Fabrik may monitor usage for compliance and may suspend or terminate accounts that violate these Terms.

Security issues may be reported to: security@aifabrik.com
No Warranties
The Services are provided “as is” without warranties of any kind, including accuracy, reliability, or availability.
Limitation of Liability
To the maximum extent permitted by law, AI Fabrik’s total liability shall not exceed the greater of:
- The amount paid in the previous 12 months, or
- $100
AI Fabrik shall not be liable for indirect or consequential damages, including lost profits or data loss. For clarity, this limitation applies in the aggregate across all claims.
Indemnification
You agree to indemnify and hold harmless AI Fabrik, its affiliates and their respective officers, directors, employees from and against any claims, damages, losses, liabilities and expenses (including reasonable attorney’s fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your Customer Content

Termination
AI Fabrik may suspend or terminate access immediately for violations of these Terms or security risks, or (ii) for convenience upon reasonable notice. .
You may stop using the Services and may terminate your account at any time.
Unused credits may expire unless required by law.
Force Majeure
AI Fabrik shall not be liable for failure or delay caused by events beyond its reasonable control, including outages, natural disasters, or internet disruptions.
Privacy
Your use of the Services is also governed by the Privacy Policy.
Assignment
You may not assign these Terms without AI Fabrik’s consent. AI Fabrik may assign these Terms in connection with a merger, acquisition, or sale of assets.
Modifications
AI Fabrik may update these Terms at any time. Continued use constitutes acceptance.
Governing Law
These Terms are governed by the laws of the State of California.
Disputes shall be resolved in courts located in California.
Each Party waives any right to a jury trial to the extent permitted by law.
Entire Agreement
These Terms constitute the entire agreement unless superseded by a written agreement signed by both parties.
